Estate Planning

Written by Michael J McGuire, Attorney at Law California Elder Law Center

When senior Americans are asked to list their concerns, to rank them one, two, three in importance, the outcomes are not only expected but very predictable and consistent:

  • “l want to stay at home…l do not want to be put into ‘one of those places.’ “
  • “l do not want to go broke or cause my spouse or partner to go broke.”
  • “I don’t want to be a burden on my family, dump my problems on their doorsteps.”

Estate planning helps a family or a senior answer the question, “What happens when I die? ” Who gets what, how to reduce expenses, how to protect someone, how to avoid unnecessary taxes, fees or delays? These are all very important issues and they really require action and planning.

Elder Law is about the more and more common issues for senior Americans: “What happens if I live? And how am I going to pay for that care? ” That calls for a different kind of planning, a different set of protections for seniors.

With nursing home costs often reaching $13,000 per month, having a plan in place has never been more critical, There are solutions…BUT ALL THE RULES HAVECHANGED in 2022 and again in 2023! New asset rules, new income rules, new rights for residents!
